With chlorophyll gone, other pigments in leaves become visible. These include carotenes and xanthophyll pigments, which appear yellow to orange and are present during the growing season but are masked by the green.

Reddish leaf colors stem from anthocyanins, which are only produced in the fall and are a reaction to stressful conditions. They act like sunscreen for the leaf, blocking out harmful radiation and shading it from excess light. They also help protect the plants' cells from freezing as temperatures drop.

In Syracuse and elsewhere, temperatures have begun to dip into the mid-50s (in degrees Fahrenheit) some nights, a sign of cooler temperatures ahead, Leopold told OurAmazingPlanet. Colder temperatures and shortening days serve as signals to plants to begin reducing the amount of chlorophyll produced and to start preparations for winter, which involves moving sugar and nutrients from leaves to roots.

Sufficiently cool temperatures can also directly reduce the amount of chlorophyll produced. Without being continuously renewed, chlorophyll breaks down and eventually leaves will fade from green to yellow or red.?

    Mike and Nancy Leighton's problems began on May 19, just as Mike was settling in to watch the Preakness Stakes. A neighbor in Leroy Township, Pa., called Mike and told him to check the water well located just outside his front door.

    "I said, 'I'll be down in 15 minutes.' I wanted to see the race," Leighton said. But as the horses were racing, Leighton's well was overflowing. Typically, there's between 80 to 100 feet of head space between the top of the well and its water supply. But when Leighton went outside, the water was bubbling over the top.

    Down the road, Ted and Gale Franklin's water well had gone dry. When water started coming out later that week, the liquid was "black as coal," according to Gale.

    Since then, both families have been dealing with methane-contaminated water supplies, as well as dozens of mysterious, flammable gas puddles bubbling up on their properties.

    Pennsylvania's Department of Environmental Protection blames a nearby hydraulic fracturing, or fracking, operation. It says methane gas has leaked out of the well, which is operated by Chesapeake Energy, and into the Leightons' and Franklins' water supplies.

    The danger goes beyond contaminated water. In a letter to both families detailing test results and preliminary findings, state regulators wrote that "there is a physical danger of fire or explosion due to the migration of natural gas water wells." Chesapeake has installed ventilation systems at the two water wells, but the letter warns, "it is not possible to completely eliminate the hazards of having natural gas in your water supply by simply venting your well."

    Nancy Leighton said the letter made her "a little nervous," pointing out that both families heat their homes with wood stoves and plan to do so this winter, regardless of whether the gas leaks have gone away.

    "What are we going to do? We don't have any other options," Gail Franklin says.

    A Methane Gas Express Elevator

    So how did this happen?

    The whole thing gets a bit confusing, because over and over again, the drilling industry has said fracking hasn't been linked to water contamination. Yet, here's a case where the state says a nearby natural gas well is to blame.

    Here's why they're both right.

    To frack a well, drillers crack up shale rock with explosives, then flush gas out of the ground with millions of gallons of fluid. For a long time, the fear has been that the chemicals are shot deep underground, then they and the gas find a way to seep back up a mile through the rock and the water supply.

    That hasn't been conclusively documented, but what has been proven is something much more basic, and closer to the surface. It's not the technique of fracking ? it's the pipe the gas uses to go from point A to point B that can be a problem.

    Penn State University geologist David Yoxtheimer has been studying this issue, which is called methane migration. He explained that when a well is leaky, it becomes a methane gas express elevator. "Gas wants to migrate up," he said. "It's lighter. It's less dense. It finds itself trapped in these shallower, more porous formations. And during the drilling process, you can go down through these shallow formations, and as you're drilling through, suddenly you've created a conduit for those gases to escape."

    A shoddy cement job is usually what's to blame. Gas wells are lined by a series of steel pipes surrounded by cement. And if the cement pour is rushed or poorly done, methane is going to get out of the well and into the ground. That's what state regulators say happened in 2009 in the same northeast Pennsylvania county where the Leightons and Franklins are currently dealing with stray gas.

    'We Want Things Fixed'

    Pennsylvania's Department of Environmental Protection fined Chesapeake Energy $900,000 for contaminating 16 families' water supplies. The company disputed the state's conclusion, but agreed to the fine ? the largest environmental penalty in Pennsylvania history.

    Since then, Pennsylvania regulators put much tougher drilling standards in place, in order to minimize methane leaks.

    They mandated higher-quality cement and pipes in gas wells, among other changes. Chesapeake spokesman Michael Kehs said the company has improved its standards. He says the problem affecting the Leightons and Franklins is an "isolated incident," adding, "in this particular case there was a unique problem with a particular piece of equipment that was highly unusual."

    Chesapeake is paying for water filtration devices at both families' homes, and in a statement said the malfunction that created the leak "has been identified and corrected. The surface expressions of methane have dramatically abated and are almost gone."

    But Mike Leighton, who still has bubbling puddles in his yard, said he's fed up. "The newspapers keep minimizing the damage here, but it's here," said Leighton, pointing out bubbling gas puddles on his property. "And people think we're radicals, but we're not. We're just upset about the condition of our property, and we want things fixed.

    "I want my real estate back to where it was before," he says. "And right now, it ain't worth dirt."

    Amy Emmert, a policy adviser with the American Petroleum Institute, maintains that the leaky wells are few and far between. "A typical natural gas well is constructed with 3 million pounds of steel and cement," she said.

    Still, it only takes one small hole, or one faulty piece of equipment, or one weak chunk of cement, to create problems on the surface.

    Pasta with Chorizo and Cherry Tomatoes in a Creamy Sauce

    For my second time participating in the Sunday Supper??movement the theme is Back to School 30 minute start to finish dinner meals. Though as summer comes to an end I am no longer going to back to school (and instead am embarking on a 2 year backpacking trip around the world) I do still appreciate the value of easy and quick to make meals.

    So this week I am sharing a recipe for a chorizo tomato pasta dish. I probably couldn?t even tell you what chorizo was before I studied abroad in Madrid in 2009 but since then my love for this pork product has bloomed into a wonderful affair.

    Chorizo is a Spanish sausage made with pork, pork fat, dried smoked red peppers and salt. Usually smoked this sausage can be sliced as is ready to eat but it can also be found raw in which you can cook it the way you would sweet/hot italian sausages.

    I personally prefer the cured chorizo which I usually quarter and thinly sliced and sautee lightly, until just slightly browned and crispy.

    Chorizo Pasta with Tomatoes

    Chorizo Tomato Pasta for Back to School #SundaySupper

    Recipe type: Dinner

    Prep time: 5 mins

    Cook time: 20 mins

    Total time: 25 mins

    Serves: 4

    Quick 30 minute pasta dish perfect for a busy weeknight

    • 12 ounces smoked chorizo, halved or quarter and thinly sliced
    • 1/2 small onion, diced
    • 3 cloves garlic, diced
    • 1 pint cherry tomatoes, halved
    • 1/4-1/2 cup heavy cream
    • 2 scallions, sliced
    • 8 ounces pasta,
    1. Cook pasta according to package directions.
    2. Over medium heat heat sautee pan and add chorizo. Cook 5-10 minutes or until slightly browned and crispy. Drain some of the grease.
    3. Add onions and cook until translucent, 4-5 minutes. Add garlic and cook for 1 minute.
    4. Add cherry tomatoes and cook for 4-5 minutes or until juices starting to run.
    5. Add cream and reduce heat to low. Simmer on low heat for a few minutes.
    6. Serve sauce over the pasta and sprinkled with scallions.

    I often work as a professional coach to executives, physicians, lawyers and others. One of the issues that frequently comes up in coaching is how best to cope with angry bosses, coworkers,or clients who suddenly or repeatedly appear. Skill in dealing with such people is no small matter ? depending on our skillfulness,encountering and angry person can be a minor bump in the road or can upset us for the rest of the day. If we lose our balance, not only is it much less pleasant to be inside our own skins, but our effectiveness at completing tasks and communicating with others can be substantially diminished. The good news is that there are a few easily remembered steps that anyone can make use of with a little practice and powerful results.

    When beginning to deal with an angry person,the first step is always to listen. This is done with eye contact, but very few words, until the initial wave of angry energy pauses for the first time. During that interval, listen for the factual content of what that person thinks is their concern, while letting the emotional content wash by without ?hooking? you. Don?t put much effort into sharing information at this point.     you heard, and/or a finishing question asking if your understanding is accurate. This might sound something like: ?Can I make sure I heard you correctly?? Rest assured

    that the answer to this question will always be ?yes?. This person wants to be heard! Understand that you are teaching two concepts to the angry person at this point: that you have heard the essence of their statement, and that you have not moved into anger yourself. You have remained sane in the presence of their unbalanced state, and are not becoming their enemy.

    There is magic built into what you have just accomplished in justa minute or so of time and a few simple words. You have managed to share with someone who is feeling attacked and vulnerable (and who is barely able to listen to anyone) that not

    only are you not angry in response to their anger, but that you have actually understood what they are upset about accurately.

    Furthermore, if you asked and were given permission to make a mirroring statement to prove you heard them correctly,

    Mears gets pole after washout at Bristol

    (AP) ? Kyle Busch has three races remaining to claim a spot in the 12-driver Chase for the Sprint Cup championship.

    Under normal circumstances, his chances would be good headed into Saturday night's race at Bristol Motor Speedway. Busch, after all, has five Cup victories at Bristol.

    But that was before track owner Bruton Smith decided grinding the race track would potentially lure fans back to the track after several years of declining attendance. Asked Friday what he thought of the changes, Busch offered a succinct assessment:

    "Terrible," he said.

    He was one of the few drivers with a strong opinion after two Friday practice sessions. Qualifying was washed out by rain, and Casey Mears and Brad Keselowski will start on the front row because the field was set by practice times. Keselowski has won the last two Cup races at the track.

    Few drivers ventured into the top groove during practice, and insisted it's too early to tell how the race will develop.

    Smith is hoping the race proves Bristol is once again one of the most exciting tracks in NASCAR. After yet another ho-hum Bristol race in March, Smith had the top lane ground down in an effort to eliminate the two-wide racing that fans believed ruined the product. Progressive banking was added to the track in 2007, and the bumping and banging that was a Bristol trademark disappeared.

    The track had a streak of 55 consecutive sellouts from 1982 until 2010, and Smith believed tightening the track might bring the fans back.

    Busch was one of the drivers who didn't bother to run at the top of the track on Friday. Why didn't he check it out?

    "I don't have to," he replied, "I watched the Truck race."

    Timothy Peters led all 204 laps ? and the first 82 were under green ? in Wednesday night's truck series race. Drivers kept an eye on that race, and voiced their frustrations with Smith's track on Twitter.

    "Just as expected. Killing the top groove doesn't make the bottom groove any better," tweeted Martin Truex Jr.

    Carl Edwards, who also needs a win to move into Chase contention, said he's reserving judgment on the track until after the race. He stayed out of the top groove in practice ? a combination of habit and "I don't want to be the first guy to go up there if there's no grip" ? and said nobody knows what it will be like during the race.

    "They changed the track because everybody wanted it to be two or three grooves and then they changed it back," Edwards said. "I give them a lot of credit for doing the very best they can. This is one of the coolest race tracks in the world and I think they've done everything they can to make sure we have the best show that we can have and it will be an exciting race one way or another."

    Matt Kenseth wasn't even sure the track needed to be changed. He surmised the push for changes snowballed, perhaps in part to the presence of social media.

    "Everybody talks about the old Bristol and people knocking each other out of the way and fighting and all that stuff. Well, we raced these cars at Bristol before they reconfigured it and there was hardly any passing," Kenseth said. "Things change over time and I thought the race in the spring was pretty good. Everybody is going to want something different. We tried to narrow the track up and take grooves away to take passing away, so I'm a little confused on the whole concept to start with.

    "I think all of the races are pretty good here. I haven't really seen a real bad one here. I think the racing is always entertaining."

    Mears was another driver who had no idea what to expect Saturday night.

    "Where they actually worked on the track, we haven't actually been all the way up there yet," Mears said. "I've seen some guys flirting with the edge of it, so it's really going to be hard to say. If it keeps guys from running up against the wall, I think it could make it a little bit more competitive just because when guys are running right up against the fence and it's really hard to pass guys down underneath."

    Holmes made threats, was barred from campus

    CENTENNIAL, Colo. -- The prosecution in the James Holmes mass murder case said on Thursday that the suspect's school life is linked to the July 20 shootings that killed 12 people during a midnight screening of the new Batman movie. Karen Pearson, a lawyer with the Arapahoe County District Attorney's office, said during a hearing that Holmes was also barred from campus after he made threats in June.

    "What's going on in the defendant's [education] life is extremely relevant in this case," Pearson said. She said Holmes' threats to campus, his grades, emails and withdrawal from the University of Colorado in 2011 are tied to his purchasing ammunition, body armor and explosives.

    Particularly notable, she said, was Holmes' failed oral examination on June 7, just weeks before the theater attack.

    "All of that is relevant," Pearson said, "and goes to his decision to withdrawal from school and booby trap his apartment with explosives and commit this act."

    Defense attorney Daniel King, at times angry and animated, accused the prosecution of illegally obtaining documents and said it was inappropriately "fishing" for any information on the suspected shooter.

    During the hour-long hearing, King told Judge William Sylvester he believed prosecutors unlawfully seized documents that relate to Holmes' education. Those records include Holmes' admission application, course work, class grades, oral exam results, school emails, and his petition for withdrawal from the school. Holmes was pursuing a Ph.D. in neuroscience.

    "We now have a pattern of conduct going on in which the prosecution is illegally obtaining documents," King said during the procedural hearing at Arapahoe County District Court. Saying the legal process was "deteriorating," King told Judge Sylvester he suspects the DA's office already knows much of the information they're formally asking for in court.

    "Judge, they've already got what they're saying they're seeking," King said.

    The school motive, King said, is behind the prosecution's "fishing expedition," a phrase he repeatedly used to describe tactics across the courtroom.
    But "motive is irrelevant," King said.

    Pearson denied any illegality and said she had a signed order to obtain the records.

    "The defense is implying we have obtained those in some illegal manner, and we have not," Pearson said. She said Holmes' grades, relationships with professor and communication with the school could be tied to "the planning of the acts." The DA's office has also requested campus police records on Holmes, and a behavioral threat and health assessment of Holmes that she said is relevant to the shootings.

    However, according to the Associated Press, the University of Colorado said in writing that there were no documents related to Holmes' campus ban. That conflicts with the prosecution's arguments on Thursday.

    Holmes, who faces 142 counts stemming from the rampage, sat still and said nothing during the hearing. His orange-red hair is browning at the roots, and he still dons a red jail jumpsuit. He will appear in court on Aug. 30 for another hearing. His university psychiatrist, Dr. Lynne Fenton, is expected to testify then.

    Attorneys on Thursday also argued over whether Fenton and other psychiatric professionals are considered, for legal purposes, medical doctors, and thus whether Holmes' relationship and communication with Fenton is privileged information. Prosecutors also said Holmes sent a notebook to Fenton that contains violent descriptions. Prosecutors want access; the defense team argues the notebook is covered under doctor-patient privilege.

    King further told Sylvester that no communication from a psychiatric professional could be uttered without a patient waiving privilege, and that records are protected under state and federal laws.

    Sylvester asked defense lawyers to provide him with written arguments on that matter by noon on Friday.

    (AP) ? John Lennon's killer was denied release from prison in his seventh appearance before a parole board, New York corrections officials said.

    Mark David Chapman, 57, was denied parole by a three-member board after a hearing Wednesday, the state Department of Corrections said Thursday. The transcript of his latest hearing wasn't immediately released.

    Chapman shot Lennon in December 1980 outside the Manhattan apartment building where the former Beatle lived. He was sentenced in 1981 to 20 years to life in prison after pleading guilty to second-degree murder. The musician, singer and songwriter was 40.

    "Despite your positive efforts while incarcerated, your release at this time would greatly undermine respect for the law and tend to trivialize the tragic loss of life which you caused as a result of this heinous, unprovoked, violent, cold and calculated crime," board member Sally Thompson wrote. Board members Joseph Crangle and Marc Coppola agreed.

    "The panel notes your good conduct, program achievements, educational accomplishments, positive presentation, remorse, risk and needs assessment, letters of support, significant opposition to your release and all other statutory factors were considered," Thompson wrote. "However, parole shall not be granted for good conduct and program completions alone."

    Chapman can try again for parole in two years.

    He was transferred in May from the Attica Correctional Facility in western New York to the nearby Wende Correctional Facility. Both are maximum security. The prison system doesn't disclose why inmates are transferred.

    At his previous hearing, he recalled that he had considered shooting Johnny Carson or Elizabeth Taylor instead, and said again that he chose Lennon because the ex-Beatle was more accessible, that his century-old Upper West Side apartment building by Central Park "wasn't quite as cloistered." Chapman fired five shots outside the Dakota apartment house on Dec. 8, 1980, hitting Lennon four times in front of his wife, Yoko Ono, and others.

    The former security guard from Hawaii said that his motivation was instant notoriety but that he later realized he made a horrible decision for selfish reasons.

    "I felt that by killing John Lennon I would become somebody and instead of that I became a murderer and murderers are not somebodies," Chapman told the board two years ago.

    Ono, 79, had said two years ago that she was trying to be "practical" in asking that her husband's killer remain behind bars. She said Chapman might be a danger to her, other family members and perhaps even himself.

    In a 1992 interview at Attica, Chapman told Barbara Walters that it was dark when he shot Lennon in the back with a .38-caliber revolver after he exited a limousine, headed up the walkway to his apartment building and looked at Chapman. "I heard this voice ? not an audible voice, an inaudible voice ? saying over and over, 'Do it, do it, do it,'" Chapman said. He explained, "I thought that by killing him I would acquire his fame."

    He has been in protective custody with a good disciplinary record, according to corrections officials.

    Mortgage buyer Freddie Mac says the rate on the 30-year loan increased to 3.66 percent, up from 3.62 percent last week. Four weeks ago, the rate fell to 3.49 percent, the lowest since long-term mortgages began in the 1950s.

    The average on the 15-year fixed mortgage, a popular refinancing option, edged up to 2.89 percent. That's up from 2.88 percent last week and from the record low of 2.8 percent four weeks ago.

    The availability of low rates has lifted home sales higher this year. Prices also have increased, largely because the supply of homes has shrunk while sales have risen.

    Builder confidence is also at its highest level since March 2007, according to a survey by the National Association of Home Builders.

    The housing market's recovery will likely add to economic growth in 2012 for the first time in seven years. Home purchases, construction and prices are gradually but consistently increasing, though they remain far below levels seen in a healthy economy.

    Sales of previously occupied homes rose 2.3 percent in July from June to a seasonally adjusted annual rate of 4.47 million, the National Association of Realtors reported this week. Over the past 12 months, sales have jumped more than 10 percent.

    New-home sales have been strengthening, too. Sales in the United States rose 3.6 percent in July to match a two-year high reached in May, the Commerce Department said Thursday. The seasonally adjusted annual rate last month was 372,000, though still well below the 700,000 pace that economists consider healthy.

    Toll Brothers, a builder of high-end homes, is enjoying its most sustained demand in more than five years.

    All of which is a big change for the residential real estate industry, which has been a major drag on the economy since the housing bubble burst more than five years ago.

    Still, the housing market has a long way to go to reach a full recovery. The pace of home sales remains well below healthy levels. Many people are still having difficulty qualifying for home loans or can't afford larger down payments required by banks.

    Mortgage rates are low because they tend to track the yield on the 10-year Treasury note. A weaker U.S. economy and uncertainty about how Europe will resolve its debt crisis have led investors to buy more Treasury securities, which are considered safe investments. As demand for Treasurys increase, the yield falls.

    To calculate average rates, Freddie Mac surveys lenders across the country on Monday through Wednesday of each week.

    The average does not include extra fees, known as points, which most borrowers must pay to get the lowest rates. One point equals 1 percent of the loan amount.

    The average fee for 30-year loans was 0.7 point, up from 0.6 point last week. The fee for 15-year loans also increased to 0.7 point from 0.6.

    The average rate on one-year adjustable rate mortgages fell to 2.66 percent from 2.69 percent last week. The fee for one-year adjustable rate loans was unchanged at 0.4 point.

    The average rate on five-year adjustable rate mortgages rose to 2.8 percent from 2.76 percent. The fee held steady at 0.6 point.

    Spending missteps make Brown tax plan a hard sell

    SACRAMENTO, Calif. (AP) ? California Gov. Jerry Brown has made austerity a hallmark of his administration, telling state workers they must turn in their cellphones, selling off state vehicles, severely reducing employee travel and cutting billions from the general fund.

    Brown was counting on that record to help him sell his November ballot initiative seeking to boost the state sales and income taxes temporarily to close what was a $15.7 billion budget deficit and avoid further cuts to education.

    Yet a summer of headlines about state spending scandals and Brown's own push for some of the nation's most expensive infrastructure projects has threatened to undermine that carefully crafted message and jeopardize the success of his tax initiative.

    Opponents are mocking his message that voters can be assured their money will be handled responsibly if the higher taxes are passed. The critics also pounced on a scandal in which state parks employees hid millions of dollars while threatening to close dozens of parks.

    One group opposing his initiative asked in a radio ad this week: "What else are they keeping from us?"

    The bad news for Brown also includes a disclosure of pay raises to legislative staffers already making six figures. And at a time when he says the state does not have enough money for schools, he approved the first stage of a $68 billion high-speed rail system and announced plans for a $24 billion tunneling system to move water from north to south.

    His initiative also faces several competing tax questions, including a well-financed campaign to raise state income taxes for education and dozens of tax increases pushed by local governments.

    It all adds up to a tough sell for a governor who says he wants to end the state's cycle of crippling budget deficits.

    As Brown kicked off his campaign for Proposition 30 at a Sacramento high school last week, he sought to emphasize that most of the revenue from the tax increases would come from Californians who are among the wealthiest; an extra $4,500 a year for millionaires, he said.

    "This is not about any other issue. It's not about pensions, it's not about parks. It's about one simple question," the Democratic governor told reporters outside the school. "Shall those who've been blessed beyond imagination give back 1 or 2 or 3 percent for the next seven years, or shall we take billions out of our schools and colleges to the detriment of the kids standing behind us and the future of our state?"

    Brown continued his campaign tour Wednesday at a San Francisco school, where he acknowledged that the tax initiative is a tough sell. Yet he urged voters not to take out their frustrations with politicians on children.

    "There's a lot of naysayers out there saying, 'Oh, there's something wrong in government,' or 'These politicians are doing something, therefore, punish the kids,'" Brown said.

    The budget Brown signed into law this summer includes about $6 billion in automatic cuts to schools, higher education and other state programs that could take effect if voters reject the tax increases ? a tactic intended to help sell it because voters are more inclined to raise taxes for education than any other cause. Some school districts could cut three weeks from the school year if the tax initiative fails.

    Proposition 30 calls for higher tax rates on incomes of more than $250,000 for seven years and a quarter-cent increase in the statewide sales tax for four years.

    Brown is keeping a campaign promise not to raise taxes without a public vote, but has been forced to defend himself against problems not of his making.

    Legislative leaders were compelled to acknowledge that they had handed out hefty pay raises to staffers, including some who already had six-figure salaries.

    Then it was revealed that a bureaucrat in the state parks department had authorized a secret vacation buy-back program for senior staffers, netting them thousands of dollars each, and Brown's administration revealed that state parks officials kept $54 million hidden for more than a decade as Californians were being asked to help save 70 parks.

    That led to an investigation into accounting irregularities in hundreds of other special funds, many of them financed by voter-approved fees and taxes.

    "Convincing voters to tax themselves is always an uphill fight, but every one of these incidents over the summer makes his path a little bit steeper," said Dan Schnur, director of the Jesse M. Unruh Institute of Politics at the University of Southern California and a former Republican consultant.

    The high-speed rail plan, which has come under intense criticism, already has been targeted by the opposition campaign, which seized on the summer's missteps as evidence that politicians can't be trusted with more tax revenue.

    The No on 30 campaign released an Internet video coinciding with the end of the Legislature's summer recess to "welcome politicians back from vacation," using television coverage of the scandals and misspending.

    "All of these issues speak to the management of our tax dollars in Sacramento ... and that is a part of this discussion on Prop. 30," said Joel Fox, president of the Small Business Action Committee and a spokesman for the opposition campaign.

    California voters are generally not inclined to support tax increases and have rejected the last eight statewide measures on the ballot, including a June proposal to raise taxes on cigarettes to fund cancer research.

    They are far more likely to support taxes on the rich rather than themselves, but Brown's initiative includes a sales tax hike that undercuts that selling point. This year, he persuaded union supporters to drop a more popular "millionaire's tax" in favor of his plan.

    Still, the opposition campaign has anemic funding from business groups that back it compared with the millions from Brown's union allies.

    Backers of Proposition 30, which had a slim lead in summertime polls, have raised more than $10 million to date, with millions more pledged by independent supporters. Opponents have collected less than $500,000.

    The governor said if voters reject the taxes, he'll follow their will and make deep spending cuts. But he hoped they will be able to focus on the risk to schools if his initiative fails.

    "Proposition 30 is only one thing: it's either a yes or a no," he said. "And it's about schools, it's about money, it's about balancing the budget, it's about public safety. And people will decide."

    Legal Schnauzer: Why Does Jerry Sandusky Inspire Fear, While ...


    In the wake of the Penn State scandal, state legislatures considered a blizzard of bills that would strengthen requirements for reporting suspected child abuse. By our count, 14 states passed what could be called "Jerry Sandusky laws."

    These new measures appear to be a reaction to the Sandusky case, where the former Penn State assistant football coach was convicted on 45 counts of child sexual abuse. The states seem to be saying, "We want to make sure that someone like Jerry Sandusky cannot take advantage of children in our jurisdiction."

    So consider the irony that states are welcoming Campus Crest Communities, a Charlotte-based development company that has student-housing projects completed, or in the works, at 36 sites across the country. No one seems concerned that CEO Ted Rollins has an assault conviction on his record, for the brutal 1995 beating of his 16-year-old stepson in Franklin County, North Carolina. The beating, which caused the stepson to be rushed to a hospital emergency room via ambulance, clearly was a case of child abuse, as defined by North Carolina law. But the case went unreported in the press, and Rollins got off with what amounts to a wrist slap in court.

    The business community seems to have no problems with the ugliness in Rollins' past. Investors rewarded his company with a $380-million Wall Street IPO in late 2010. And the CEO was a guest on the Fox Business Network's "Closing Bell" on Monday, discussing his plans to make boatloads of cash by renting apartments to college students. (You can view the video at the end of this post.)

    In the first few moments of the interview, Rollins states that he started Campus Crest Communities in 2004, so it existed when his Alabama divorce was finalized in 2005. That means the company was a marital asset, under the law, and ex wife Sherry Carroll Rollins was entitled to a portion of the proceeds. But that did not happen, and Ted Rollins received such a favorable result from Shelby County Circuit Judge D. Al Crowson that his ex wife and two daughters, Sarah and Emma Rollins, have been on food stamps here in Birmingham.

    Liz Claman, host of "Closing Bell," seemed to have zero interest in Ted Rollins' documented history as a child abuser, deadbeat dad, and courtroom cheat. Here is a question that Claman could have asked: "Mr. Rollins, you just stated that you started a student-housing company in 2004, but a child-support affidavit dated 2005 in your Alabama divorce case states that you made $50,000 a year at that time. How could you start a nationwide company when your only asset, as you swore under oath, was an annual salary of $50,000? You must be either an otherwordly business genius or a perjurer. Which one is it, Mr. Rollins?"

    In essence, Ted Rollins confessed to perjury on national television--and it zipped right past Liz Claman, who was busy gushing about Campus Crest's potential to "make money." Perhaps we shouldn't expect the Fox Business Network to ask tough questions of a CEO.

    As for the rash of "Jerry Sandusky laws" in 2012, we are left to ponder this troubling question: Why are states embracing a company that is led by a documented child abuser while rushing to pass new laws driven by a headline-grabbing case of child abuse? In fact, some of the states that recently passed "Sandusky laws" also have Campus Crest apartment complexes at public universities--and no one seems to have a problem with it.

    How is that for irony? Do we, as a society, only care about child-abuse cases that produce shocking headlines? What about cases that were largely kept under wraps by law enforcement, health-care officials, and the press? Do we care about those victims?

    The stomach-churning details in the Sandusky case clearly had an impact on state legislatures, according to a report in the Christian Science Monitor (CSM). About 105 bills related to the reporting of suspected child abuse were introduced in 30 states and the District of Columbia for 2012 legislative sessions. Reports CSM:
    When the child sex abuse scandal at Penn State erupted last year, public anger was not only directed toward Jerry Sandusky . . . but toward the people around him who didn't report their suspicions to police.?
    In the months that followed, that anger led many states to re-examine and expand their so-called mandatory reporting laws that require people to report suspected abuse or face civil and criminal penalties. Some state laws apply to professionals like doctors and teachers, while others apply universally to all adults.

    The CSM article is based largely on a report from the National Conference of State Legislatures (NCSL). CSM puts the number of states passing "Sandusky laws" at 10, while my count is 14. Either way, let's focus for a moment on the following states: Georgia, Iowa, Indiana, and Washington.

    Those four states passed "Sandusky laws" in 2012. They also have welcomed Campus Crest CEO Ted Rollins, a documented child abuser, into their environs. If that causes you to scratch your head, you certainly have company in me.

    In fact, let's consider the full roster of states that have Campus Crest sites and ponder this question: Do these states care about the victims of child abuse or do they simply hope to avoid the kind of publicity that comes with a high-profile case such as the one involving Jerry Sandusky?

    The Campus Crest roster seems to vary from source to source, but our best guess at the total number of formally approved sites is 36.
